The Resident Welfare Association (RWA) is classified as the Association of Person (AOP) under the Income Tax Act. The Resident Welfare Association (RWA) is an organization that is in the interest of individuals of Individuals living in society or in the society. In -charge of the organization is in charge of observing the daily problems of the residents of the association, sorting of programs, monitoring facilities in apartments and buildings, and representing members when and wherever necessary.

What is RWA Registration for RWA in India?

  1. A Resident Welfare Association (RWA) is an organization for the welfare of individuals living in a community or society.
  2. All RWAs are required to register and fall under a particular jurisdiction which is legally liable for punishment/penalty in case of default or anarchy.
  3. Chairman, Vice-Chairman, Secretary, Joint Secretary, Treasurer and Executive Member
  4. Seven or more persons may subscribe their names to the Memorandum of Association and file with the Registrar of Societies to constitute a society under the Societies Registration Act, 1860.

Eligibility criteria for RWA Registration in India

  1. A residential society
  2. No member should have been criminally prosecuted.
  3. The society should get basic facilities.

Documents required to obtain an RWA Registration

Documents required for RWA registration

  1. Covering letter.
  2. List of body members (name, full address, occupation and signature on list).
  3. Address proof of all body members (Voter ID/Aadhaar/Driving License).
  4. Address proof of society registered address (utility bill / rent agreement with NOC from owner).
  5. PAN card of all members of the body.
  6. Memorandum and Bylaws of Proposed Association.
  7. An affidavit of the President (on stamp paper, notarized).
  8. Power of Attorney.
  9. Building Completion Certificates issued by concerned authority (if applying for Apartment Owners’ Association in some states).
  10. Consent and/or Representation of Builders (if applying for an Apartment Owners Association in some states).
  11. Home Registry Copy (apply for creation of RWA only).
  12. Buyers Association Essential Requirements: If Form at State Level – At least 7 Body Members from the same State OR Format at Central Level – At least 7 Members from each State.
  13. RWA/Apartment Owners Association Essential Requirements: Minimum 7 body members from same state. In the case of AOA, this minimum number varies from state to state, according to the state apartment ACT.
